Terms of service

Last updated 22 October 2026

About these terms

These terms apply when you use Everhere (everhe.re), a service for creating and visiting digital memorial pages. Everhere is provided by Northiom AS, a Norwegian private limited company (org. no. [ORG NUMBER]), [STREET ADDRESS], Gjøvik, Norway, hello@everhe.re.

You accept these terms when you create an account. Please also read our privacy policy, which explains how we handle personal data.

If you use Everhere as a consumer, nothing in these terms limits the rights you have under mandatory consumer law.

Who can use Everhere

  • You must be at least 13 years old, or older if your country requires it, to have an account.
  • You must be at least 18 years old to create a memorial or make a payment.
  • You sign in with your own Google account and are responsible for what happens on your account. Keep your Google account secure.
  • You may not use Everhere if we have closed your account for breaking these terms.

What Everhere offers

An owner can create a memorial page for a person who has died, with details about their life, photos and a life story. Visitors can read the memorials that are shared with them, and signed-in users can leave greetings, memories, photos and symbolic tributes such as candles when the owner allows it.

We may develop, change or remove features. We will not reduce what you have already paid for during an active period without telling you and offering a fair remedy.

Memorial owners

  • You may only create a memorial for a person who has died. Memorials for living people, pranks and impersonation are not allowed.
  • You confirm that you are a close relative or friend acting with the family's blessing, or otherwise have a legitimate reason to create the memorial, and that you respect the wishes of the closest family.
  • You decide whether the memorial is public or private, who may contribute and whether contributions need approval. You are responsible for moderating the content on your memorial.
  • If close relatives disagree about a memorial, we may restrict or remove it at our discretion. We do not decide family disputes.

Your content and your responsibility

You are responsible for everything you publish on Everhere, including text, photos and information about other people. When you publish something, you confirm that:

  • you own the content or have permission from the rights holder, such as the photographer, to publish it;
  • people who can be recognised in photos you upload have agreed to it, and a parent or guardian has agreed for children;
  • you do not publish sensitive personal data about living people, such as their health, religion, sexual orientation, finances or address, without their consent;
  • the content is correct to the best of your knowledge and does not violate anyone's rights or any law.

If someone makes a claim against us because of content you published in breach of these terms, you are responsible for it under applicable law.

Content that is not allowed

You may not publish or do the following on Everhere:

  • content that is unlawful, including defamation, threats, harassment, hate speech or incitement to violence;
  • content that violates privacy, copyright, trademarks or other rights;
  • sexual content, or gratuitously graphic or disturbing images;
  • memorials for living people, false information presented as fact, or impersonation of others;
  • advertising, spam or requests for money, although you may mention a charity the family supports;
  • malware, attempts to access other people's accounts or data, automated collection of content, or other misuse of the service.

Permission you give us

You keep all rights to your content. You give Northiom AS a non-exclusive, worldwide and royalty-free permission to store, copy, resize, display and transmit your content as needed to provide Everhere, for as long as it is on the service. The permission ends when the content is deleted, except for copies we must keep by law and short-lived backups.

We do not sell your content, use it for advertising or use it to train artificial intelligence models.

Reporting, moderation and complaints

Anyone can report content they believe is unlawful or breaks these terms, using the report link on the memorial page or by emailing hello@everhe.re. Please include the address of the page, which content you mean, why you believe it is unlawful or not allowed, and your name and email address. Reports must be made in good faith.

We confirm receipt, review reports carefully and objectively, and may remove or disable content, restrict a memorial or suspend an account. We tell the person who published the content what we did and why, unless the law prevents it or the report is clearly unfounded.

If you disagree with a decision we made about your content or your report, reply to our message within six months and we will review it again.

Memorial owners moderate their own memorials and may hide or delete contributions without giving reasons. We do not check all content before it is published and are not responsible for content published by users, but we act on reports as described here.

Prices and payment

Preparing a memorial is free. To publish and keep a memorial active, you buy an active period: 12 active months for $29 or 5 active years for $99. Prices are total prices in US dollars, including VAT where applicable. If you pay in another currency, your bank or card issuer may charge conversion fees. There is no subscription, and nothing is renewed or charged automatically.

Payments are processed by Stripe. Each payment adds its period to the memorial. If the memorial is active, the period is added to the end of the current period; if it is unpublished or in archive mode, the period starts when the payment is completed. Several people can pay at the same time, and every payment adds its own period.

If the owner allows it, other signed-in users can pay to extend a memorial. Paying does not give any right to manage the memorial, and the owner can see the payer's name and the period paid for.

After each payment you receive a confirmation by email.

Active period and archive mode

While a memorial is active, the owner can add content and visitors can contribute. When the active period ends, the memorial moves to archive mode. It stays online and can be read as before, but new photos, greetings, memories and tributes are paused until someone extends the period. We email the owner a reminder before the period ends.

In archive mode the owner can still change privacy settings, correct details, manage invitations, moderate contributions, export the content and delete the memorial.

Right of withdrawal

If you are a consumer, you can withdraw from a purchase within 14 days of the payment without giving a reason.

When you pay, you ask us to start the active period immediately. If you then withdraw within the 14 days, we refund what you paid minus a proportionate amount for the days the memorial was active before you told us.

To withdraw, send us a clear statement, for example by replying to your payment confirmation or emailing hello@everhe.re. You may use this form:

  • To Northiom AS, [STREET ADDRESS], Gjøvik, Norway, hello@everhe.re:
  • I hereby give notice that I withdraw from my contract for the following service: [12 active months / 5 active years] for the memorial [name].
  • Paid on: [date]. Name: [your name]. Email: [your email]. Date: [today's date].

We refund without undue delay and no later than 14 days after receiving your notice, using the same payment method. A refund shortens the memorial's active period by the refunded share of the period. If every payment for a memorial has been refunded, it returns to an unpublished draft that only the owner can see.

If something is wrong

If the service does not work as agreed, tell us at hello@everhe.re within a reasonable time after you noticed the problem. You then have the rights that consumer law gives you, such as having the fault corrected, a price reduction or cancellation with a refund.

Availability, backups and closing the service

We work to keep Everhere available, secure and backed up, but we cannot guarantee that the service is always available or free of errors, or that content can never be lost. Keep your own copies of important photos and texts. You can export the content of your memorials at any time.

Memorials are meant to stay online for as long as Everhere operates. If we ever decide to close the service, we notify owners by email at least three months in advance, give them the opportunity to export their content and refund unused prepaid active time proportionally.

Limitation of liability

Everhere is provided as it is at any given time. To the extent permitted by law, Northiom AS is not liable for:

  • content published by users, or what other users do;
  • indirect or consequential losses, such as lost profits, loss of data you have not kept copies of, or harm to reputation;
  • interruptions or losses caused by Google, Stripe, Cloudflare or other third parties, or by events beyond our reasonable control.

To the extent permitted by law, our total liability to you is limited to the amount you have paid us in the 12 months before the event that caused the loss.

These limitations do not apply to losses caused by our gross negligence or intent, to personal injury, or where mandatory law, including consumer law, does not allow them.

Suspension and termination

You can stop using Everhere and delete your account at any time from your dashboard. Deleting your account permanently deletes the memorials you own, including their photos and contributions from others, and everything you have contributed elsewhere.

We may suspend or close an account, or remove a memorial, if you seriously or repeatedly break these terms, if the law requires it or to protect others. Where reasonable, we warn you first and give you the opportunity to export your content. If we close your account without you having broken these terms, we refund unused prepaid active time proportionally.

Changes to these terms

We may update these terms, for example when we change the service or the law changes. We tell you about important changes in advance by email or in the service, and you will be asked to accept the new terms before you continue using the service. Changes never reduce what you have already paid for. If you do not accept the changes, you can delete your account.

Governing law and disputes

These terms are governed by Norwegian law. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of the country where you live.

Please contact us first if you are unhappy, and we will try to find a solution. Consumers in Norway can also get help from Forbrukerrådet, and consumers elsewhere can contact their national consumer authority. Disputes that cannot be solved amicably are decided by the ordinary courts. As a consumer you can always bring a case before the courts where you live.
